Transcript of the Will of Joseph Hoyland 1808 - 1879

This Is the last Will and Testament of me Joseph Hoyland of 237 Allen Street Sheffield in the County of York Baker and Flour Dealer I revoke all Wills and testamentary dispositions heretofore made by me, I appoint my sons William Hoyland and Joseph Hoyland to be Trustees and Executors of this my Will I bequeath to my daughter Ann Sayles the wife of Charles Henry Sayles all the books of which I shall die possessed for her separate use free from marital control and free from legacy duty I bequeath to my daughter Elizabeth Hoyland abolutely all the residue of the household furniture and effects and the housekeeping stores of which I shall die possessed free from legacy duty I devise and bequeath all the real estate and all the residue of the personal estate to which I shall at my death be entitled unto and to the use of my said sons William Hoyland and Joseph Hoyland their heirs executors administrators and assigns according to the nature thereof respectively upon trust to sell call in and convert into money the estates in such manner as they shall think fit and out of the moneys to arise from such sale calling in and conversion as aforesaid upon trust in the first place to play or retain all the expenses of and incidental to the execution of the preceeding trusts and my debts and funeral and testamentary expenses and then to pay to each of my sons William Hoyland John Hoyland Thomas Hoyland and Alfred Hoyland the sum of one hundred and fifty pounds free from legacy duty and as to the residue of the said moneys upon trust for my said son Joseph Hoyland and my said daughters Ann Sayles and Elizabeth Hoyland in equal shares and as to the share of each of my said daughters for her separate use free from marital control and on her sole receipt I devise unto and to the use of my said sons William Hoyland and Joseph Hoyland their heirs and assigns all real estates which at the time of my death may be vested in me as a trustee or mortgage subject to the trusts and equities affecting the same respectively
In Witness whereof I the said Testator Joseph Hoyland have hereunto affixed my hand this thirtieth day of August one thousand eight hundred and seventy eight
