Transcript of the Will of Michael Weaver 1806 - 1893

This is the last Will and Testament of me Michael Weaver of Regil in the 
Parish of Winford in the County of Somerset Yeoman I nominate and appoint my son 
Isaac Weaver and my son in law Michael Weaver Trustees and Executors hereof and 
I declare that the expression “my Trustees” when hereafter used shall mean them 
the said Isaac Weaver and Michael Weaver and the survivor of them and the heirs 
executors administrators or assigns of such survivor. I give to my son John 
Weaver all my Wearing apparel. All my household goods and furniture live and 
dead Farming Stock monies and securities for money and other my personal estate 
whatsoever I give and bequeath to my Trustees upon trust that they shall sell 
call in collect or otherwise convert into money such part of the said trust 
premises as shall not consist of money and shall out of the money so realized 
and such part of my personal estate as shall consist of money pay my just debts 
and funeral and testamentary expenses and then upon trust to pay and divide the 
residue of such moneys unto and equally between all my children namely Harriett 
York Mercy Bennett Isaac Weaver Michael Weaver Thomas Weaver John Weaver Martha 
Weaver and James Weaver provided that if any child of mine shall die in my 
lifetime leaving a child or children lawfully begotten who shall survive me then 
and in every such case such last mentioned child or children shall take (and if 
more than one equally between them) the share that his her or their deceased 
parent would have taken if such parent had survived me I give and devise to my 
Trustees a close of pasture land situate at Hounsley in Winford aforesaid 
called “Little Barrow Mead” containing Three acres two roods and thirty perches 
or thereabouts and now in the occupation of my said son Isaac Weaver I also give 
to them a sum of Five hundred pounds which I hereby charge upon and make payable 
out of the land hereinafter given to my said son Isaac Weaver and which I direct 
he shall pay them within twelve calendar months after my decease with Interest 
at the rate and as hereinafter mentioned upon trust that they my Trustees shall 
let the land and invest the said sum of Five hundred pounds in the public Stocks 
or Funds or Government Securities of the United Kingdom or upon Freehold 
Securities in England or Wales (but not Ireland) or in the Debentures or 
preference Shares of any Railway Company in England or Wales (but not Ireland) 
paying a dividend upon its ordinary shares and pay the rent and income 
respectively unto my said daughter Harriett York for her life for her separate 
use and after the decease of my said daughter Harriett York upon trust to sell 
the said close of land called “Little Barrow Mead” by Auction or private 
contract and stand possessed of the net money produced thereby and of the said 
trust sum respectively unto and equally between and amongst such other of my 
said children as shall be then living and the lawful issue of such of them as 
shall be then dead leaving issue such issue taking only their deceased parents 
share and equally if more than one I give to my daughter Mercy Bennett the 
legacy or sum of One hundred pounds for her separate use absolutely and which I 
charge upon and make payable out of the land hereinafter given to my said son 
Isaac Weaver and which sum of One hundred pounds I direct that he shall pay to 
my said daughter Mercy Bennett within twelve calendar months after my decease 
with interest thereon from that time till payment at the rate of Four pounds per 
centum per annum I give and devise unto my said son Isaac Weaver his heirs and 
assigns for ever all those my several closes of land called the Meads and 
Tilsmead containing about twenty acres situate at Regil aforesaid opposite the 
church there and now in the occupation of my said son Isaac Weaver and which I 
purchased of Mr John Leach of Martock[?] but charged with the payment of the 
said sums of Five hundred pounds to my Trustees and One hundred pounds to my 
said daughter Mercy Bennett within twelve calendar months after my decease with 
interest thereon respectively at the rate aforesaid I also give and devise to my 
said son Isaac Weaver the Dwellinghouse Garden and Orchard at Regil aforesaid in 
which he now resides and occupies and which I bought of Joseph Pearce of Ubley I 
give and devise to my son Michael Weaver a close of Ground situate at Hounsley 
aforesaid called “Barrow Meads” containing about eight acres three roods and 
twenty five perches or thereabouts and now in the occupation of my said son 
Isaac Weaver I give and devise to my son Thomas Weaver absolutely a close of 
pasture land called “Gaston” (including the small Orchard at the top) containing 
about six acres and now in the occupation of my said son Isaac Weaver situate at 
Whidling Street in Regil aforesaid Also a piece of Orchard (near to Gaston) 
containing about two acres now in my own occupation and which I purchased of 
Joseph Weaver I give and devise unto my Trustees a close of pasture land called 
“Quarr Ground” containing one acre two roods and eighteen perches or thereabouts 
also a piece of land formerly called “Slot” containing three roods and thirty 
one perches now thrown into Quarr Ground Also a piece of land called “Three 
Corner Paddock” containing One rood and thirty seven perches or thereabouts Also 
a close pasture land called “Birtlands” containing about Four acres and which 
last close I purchased of Joseph Pearce all which land is situate in Winford 
aforesaid and now in the occupation of my said son Isaac Weaver Upon trust to 
let and manage the same and pay the rent and produce thereof to my daughter the 
said Mercy Bennett for her life and from and after her decease upon trust to 
sell the same lands either by public auction or private contract and to stand 
possessed of the net monies produced thereby upon trust for and to divide the 
same equally amongst the children of my said daughter Mercy Bennett lawfully 
begotten when and as they shall attain the age of twenty one years or being 
Females marry under that age I give and devise unto my Trustees a close of 
pasture land called “Bearly” containing two acres three roods and thirty one 
perches or thereabouts Also another close (now pasture formerly Arable) also 
called “Bearly” or “Cherry Orchard” containing Two acres three roods and 
thirteen perches or thereabouts Also a close of pasture land called “Brooklands” 
containing Two acres two roods and twenty one perches or thereabouts all situate 
at Strode in the parish of Winford and now in the occupation of my said son 
Isaac Weaver Also a Tenement (now used as two cottages) and Garden situate near 
the Blue Bowl Inn in the parish of Compton Martin and which I purchased of Mr 
Fry of Wells To hold to them my trustees Upon trust to let and manage the same 
and receive the rents and profits thereof and pay the same half yearly unto my 
son John Weaver during his life for his own use And I hereby declare that my 
said son John Weaver shall not have power to alienate or anticipate his income 
and from and after the death of my said son John weaver Upon trust that my 
Trustees shall sell the same closes of land and cottages either by public 
auction or private contract and stand possessed of the net monies to be produced 
by such sale (after payment of all expenses) upon trust for the others of my 
children who may be then living in equal shares and the lawful issue of such of 
them as may be then dead leaving issue such issue to take only his her or their 
deceased parents share and if more than one equally All that my farm and lands 
called “Woodwick Farm” containing Twenty nine acres and two perches and a half 
or thereabouts situate in the said parish of Compton Martin and now in the 
occupation of my said son Thomas Weaver which I purchased of Mr Fry of Wells and 
which was conveyed to me by an Indenture dated the twenty fifth day of March One 
thousand eight hundred and seventy eight and comprised in the first Schedule to 
that Deed I give and devise the same unto and equally between my said Daughter 
Martha Weaver Wife of Michael Weaver of Dundry and my said son James Weaver as 
tenants in common the share of my Daughter Martha Weaver to be for her separate 
use provided and I do hereby declare that in case my said son Isaac Weaver shall 
make default in payment to my Trustees within Twelve calendar months after my 
decease of the said sum of Five hundred pounds and interest then and at any time 
thereafter it shall be lawful for my Trustees to raise the same together with 
all expenses by sale of such portion of the said land charged therewith as may 
be necessary for the purpose and as they shall think proper and to convey the 
land as sold to the purchaser or purchasers thereof and to give effectual 
receipts for the purchase moneys provided also and I hereby give my said 
Daughter Mercy Bennett a similar power of sale in case of default in 
payment by the said Isaac Weaver of her said legacy or sum of One hundred pounds 
and interest I hereby revoke all Wills and Testimentory dispositions heretofore 
made In witness whereof I have to this my Will contained on five sheets of paper 
set my hand this eighth day of May One thousand eight hundred and eighty five.

On the Twenty third day of February 1894 Probate of this Will was granted at 
Bristol to Isaac Weaver and Michael Weaver the Executors
